How? Through nullification.

When a state ‘nullifies’ a federal law, it is proclaiming that the law in question is void and inoperative, or ‘non-effective,’ within the boundaries of that state; or, in other words, not a law as far as that state is concerned.

The ties between England and what would become the United States of America were severed, as Tench Coxe, delegate from Pennsylvania to the Continental Congress, put it, in large part due to the perversion and mal-administration of the British government.[i] Two hundred years later, Americans are manifesting similar levels of frustration with government and inflammatory terms like secession are being used by politicians ever anxious to grab the media spotlight and secure their re-election.  But what have they done exactly to correct the “perversion and mal-administration” of the government?

Our founders, astute students of history, well understood as St. Augustine had described, Libido Dominandi, the lust to dominate. They knew that if permitted, the federal government would transgress the limits of the constitution, and, as Thomas Jefferson remarked, “[annihilate] the state governments and erect upon their ruins a general consolidated government.”[ii]

Mr. Jefferson wrote in 1799, “lest [our] silence be construed into an acquiescence…the states…being sovereign and independent, have the unquestionable right to judge of [the federal government’s] infraction; and “That a nullification, by those sovereignties [states] of all unauthorized acts done under color of that instrument [the Constituion] is the rightful remedy.[iii]

Mr. Jefferson understood that a stronger response than mere petitions and protests would be necessary but he sought ever to preserve the union and thus viewed secession only as a last resort. (more…)

How Do You Spell Freedom?

Now that Heath Care legislation has passed, the obvious question for opponents is this: Now What? My answer is best summed up with just one word:

Marijuana.

No, I don’t mean that you should go out and smoke away your anger and frustration. Instead, you should feel empowered. The best way to explain this is by telling the story of a disabled mother from Northern California.

ANGEL’S STORY

Angel Raich has been permanently disabled since 1995. She has an inoperable brain tumor, a seizure disorder and other serious medical conditions. In 1997, her doctor felt that marijuana would be an effective medication.

Angel used homegrown marijuana, and she and her physician claim that it’s helped significantly. You may not agree with Angel’s choice, but it’s one made in accordance with California state law, which allows for such use. The federal government, however, has not shown much respect for state laws in recent decades, and chose to take action. After DEA agents seized and destroyed all six of her marijuana plants, she sued to stop them from doing so again.

The suit went all the way to the Supreme Court, and in Gonzales v Raich, Angel lost. The 2005 ruling made clear that the federal government did not recognize state laws authorizing the use of marijuana – in any situation.

THE COMMERCE CLAUSE

The court ruled that control over a plant grown and consumed on one’s own property was authorized under the “Interstate Commerce Clause” of the Constitution. Article I, Section 8, Clause 3 of the Constitution empowers Congress to “regulate…commerce among the several states.” It has never been amended.

Like any legal document, if the words of the Constitution mean today what they meant at the moment it was signed, we must understand just what those words meant at the time of its ratification. (more…)

Can you imagine… Tom Woods being interviewed by a progressive host who tried to skewer him?  Frank, the host, thought he had some great questions that would trip up Dr. Woods and make him look foolish, but Tom was having none of it.  Frank was not very educated on the subject of nullification.  Perhaps if he had watch Tom’s “Interview with a Zombie” he would have known which questions to avoid.

“Handing the federal government a piece of paper, patting it on the back and saying ‘now go limit your power’ is just not going to work.  Limiting power has to come from an entity outside the federal government.  Thomas Jefferson’s answer was the states.”

“The federal courts are part of the problem.  As part of the federal government itself, the courts cannot be reliable arbiters of the extent of federal power…For example, it took the Supreme Court 60 years before it ruled just one time that the federal government went beyond it’s constitutional powers under the commerce clause.”

The Constitution Means What it Says!

“The Constitution is the supreme law of the land, and it specifically delegates certain powers to the federal government. All other powers are reserved to the People or the States. The Federal government has moved out of that framework over the last several decades.”

The only solution to our nation’s economic woes is freedom’s expansion. Washington politicians, whom many have spent the majority of their career working for the government, have become self-appointed experts on the economy. Their ideas and policies have bolstered increased debt and financial devastation for millions of Americans.

President Obama’s budget teeters upon sophomoric folly. His $4 trillion dollar budget has set a course of financial ruin for many families. Free market principles are being replaced with socialism and government control of business. Capitalism, which made America great and the envy of the world, is now at risk.

I dare say most junior high school students understand a simple principle; “borrowed” money cannot be used to pay off a debt. Borrowing money to pay off a debt only creates double indebtedness. It is a mystery how politicians cannot understand a simple principled fact of Economics 101.

As Washington insiders, bureaucrats, and politicians continue to “pickpocket” the taxpayers, it’s more than our money that is lost; our freedom is in jeopardy. Every legislative policy that transfers wealth from the people to the politicians will be listed on the negative side of the balance sheet of liberty. It is impossible to multiply wealth by dividing, and giving to others. (more…)
